Discover the Updated Texts in the New 'Medical Liability' Law Project

“The proposed Medical Liability Law project currently before the House of Representatives includes the establishment of a compensation fund for medical liability errors. This fund would cover compensations imposed on doctors. Additionally, the project approves stricter penalties for anyone who assaults doctors or medical facilities in response to recent recurring incidents.”

“The law has made imprisonment and fines discretionary penalties to be determined by the judge based on the severity of the committed offense. This allows the judge to either impose a prison sentence ranging from 24 hours to 3 years or solely opt for a fine. This confirms the philosophy followed by the law project to mitigate penalties and tailor them according to the severity of the incident.”

The explanatory memorandum also pointed out that the law explicitly defined medical responsibility as an “obligation to provide care” rather than achieving a “result.” This approach reflects the true legislative objective of the law project, which is to provide necessary legal protection for healthcare providers while performing their duties.

The project also includes an entire section that regulates the establishment of the Supreme Committee and its affiliated subcommittees. These committees are solely responsible for preparing reports related to citizens’ complaints or complaints referred to them by the Public Prosecution or relevant authorities to determine the responsibility of doctors.
